DMCA Policy

1. Overview

Oryx Technologies LLC, doing business as Website Upgraders ("Oryx Tech," "we," "us"), respects the intellectual-property rights of others and asks the same of users of our Services. Under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we will respond to clear notices of alleged copyright infringement that comply with applicable law and are submitted to our Designated Agent (Section 4).

Repeat-infringer accounts will be terminated in appropriate circumstances, as required by 17 U.S.C. § 512(i).

2. Submitting a Copyright Infringement Notice

If you believe content hosted on a website we operate infringes your copyright, send a written notice to our Designated Agent (Section 4). To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works at a single online site are covered by a single notice, a representative list).
  3. Identification of the material that is claimed to be infringing or the subject of infringing activity, with information reasonably sufficient to permit us to locate it (e.g. the URL).
  4. Information reasonably sufficient to permit us to contact you (mailing address, telephone number, and email address).
  5. A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner.

Knowingly making a material misrepresentation in a DMCA notice can subject you to liability for damages, costs, and attorneys' fees under 17 U.S.C. § 512(f).

3. Counter-Notice Procedure

If we remove or disable access to material in response to a DMCA notice and you believe that the removal was the result of a mistake or misidentification, you may submit a counter-notice that includes all of the following, per 17 U.S.C. § 512(g)(3):

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location at which it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which Oryx Tech may be found), and that you will accept service of process from the person who submitted the original notice or that person's agent.

On receipt of a valid counter-notice, we will forward it to the original complainant. Unless we receive notice that the complainant has filed a court action seeking an order to restrain you from infringing activity, we may restore the removed material not less than 10 and not more than 14 business days after receipt of the counter-notice.

4. Designated Agent

Notices and counter-notices must be sent to our Designated Agent. Notices sent to any other address may not receive a response. The Designated Agent for Oryx Technologies LLC is:

5. Repeat Infringers

We will terminate, in appropriate circumstances, the accounts of users we determine to be repeat infringers.
